Terms & Conditions.

These terms apply to all painting services provided by Bodes Brushes. By accepting a Quote you agree to be bound by them. Effective July 2026.

1. Definitions

In these Terms and Conditions:

“Bodes Brushes”
means Bodes Brushes (ABN 91 996 714 878), a painting business operated by Zach Bodle, of Central Coast NSW, holder of contractor licence 483217C.
“Customer”
means the person or entity named in the accepted Quote.
“Quote”
means the written quote issued by Bodes Brushes to the Customer setting out the scope of Works and the Contract Price.
“Works”
means the painting and related services described in the accepted Quote.
“Property”
means the address at which the Works are to be performed, as set out in the Quote.
“Contract Price”
means the total price for the Works as set out in the Quote, inclusive of GST.
“Commencement Date”
means the estimated start date stated in the Quote, or such other date as agreed in writing.
“Completion Date”
means the estimated completion date stated in the Quote, as may be extended in accordance with these Terms and Conditions.
“ACL”
means the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

2. Application of Terms

These Terms and Conditions apply to every Quote issued by Bodes Brushes. Acceptance of a Quote, whether by signing, emailing confirmation, paying the deposit, or otherwise confirming acceptance, constitutes acceptance of these Terms and Conditions.

These Terms and Conditions, together with the accepted Quote, form the entire agreement between Bodes Brushes and the Customer.

3. Scope of Works

The Works to be performed are as described in the accepted Quote. This agreement relates only to internal painting and expressly excludes all external painting and any other work.

Any additional works requested by the Customer beyond the Quote scope must be agreed in writing before being carried out and will be charged in addition to the Contract Price.

4. Price and Payment

The Contract Price is as set out in the Quote (inclusive of GST).

Payment is structured as follows:

  1. A deposit of 20% of the Contract Price is due upon acceptance of the Quote.
  2. Progress payments (if any) are due in accordance with any payment schedule set out in the Quote.
  3. The final balance is due within 7 days of completion of the Works.

A Bodes Brushes representative will walk the completed job with the Customer before final payment is required. Any touch-ups identified during that walk-through will be completed on the spot prior to final payment.

If the Customer fails to pay any amount by the due date, Bodes Brushes may give written notice requiring payment. If the outstanding amount is not paid within 7 days of that notice, Bodes Brushes may suspend the Works until payment is received. The Completion Date will be extended by a period equal to the duration of any such suspension.

5. Validity of Quote

The Quote is valid for the period stated on the Quote. If no period is stated, the Quote is valid for 14 days from the Quote date. Bodes Brushes is not obliged to honour a Quote accepted after the validity period has expired.

6. Commencement and Completion

Bodes Brushes will use reasonable endeavours to commence and complete the Works by the estimated dates set out in the Quote.

These dates are estimates only and are subject to delays caused by circumstances beyond Bodes Brushes’ reasonable control, including inclement weather, unavailability of materials, or access restrictions.

Bodes Brushes will notify the Customer in writing as soon as practicable of any anticipated delay and the likely revised Completion Date.

7. Bodes Brushes’ Obligations

Bodes Brushes will:

  1. carry out the Works in a proper and workmanlike manner using reasonable care and skill;
  2. use materials fit for the intended application;
  3. hold all licences and insurances required by law, including contractor licence 483217C issued under the Home Building Act 1989 (NSW);
  4. comply with all applicable laws, regulations, and Australian Standards;
  5. undertake reasonable surface preparation, including sanding, filling of minor cracks and holes, and priming where necessary; and
  6. take reasonable steps to protect floors, fixtures, and fittings from paint splatter and damage during the course of the Works.

8. Customer’s Obligations

The Customer will:

  1. provide clear and unimpeded access to the Property at all times reasonably required for performance of the Works;
  2. ensure that all areas to be painted are cleared of furniture, wall hangings, personal items, fragile items, fixtures, and fittings prior to commencement of the Works, unless otherwise agreed in writing;
  3. advise Bodes Brushes in advance of any special requirements, hazards, or relevant site conditions;
  4. obtain any consents necessary to allow access to the Property; and
  5. promptly notify Bodes Brushes of any defects, damage, or concerns regarding the Works.

If the Customer fails to comply with any of the above obligations, Bodes Brushes may charge additional reasonable costs and extend the estimated Completion Date accordingly.

9. Storage of Materials and Equipment

Where the Works are carried out over more than one day, the Customer will permit Bodes Brushes to store materials, tools, and equipment at the Property overnight in a location agreed between the parties.

The Customer will take reasonable steps to keep such items secure. Storage of materials, tools, and equipment at the Property is at Bodes Brushes’ own risk. The Customer will not be liable for any loss of or damage to such items unless caused by the Customer’s negligence or wilful default.

10. Workmanship Guarantee and Defects

All work performed by Bodes Brushes is covered under Bodes Brushes’ workmanship guarantee.

If the Customer identifies any defects in the Works within 7 days of completion, the Customer must notify Bodes Brushes in writing as soon as practicable. Bodes Brushes will inspect the reported defect and, where the defect is attributable to Bodes Brushes’ failure to exercise reasonable skill and care, will rectify the defect at no additional cost to the Customer within a reasonable time.

11. Consumer Guarantees

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantees or other right or remedy the Customer may have under the ACL or any other applicable law that cannot be excluded by agreement.

12. Limitation of Liability

Subject to clause 11, Bodes Brushes is not responsible for:

  1. loss or damage to the Customer’s personal property that is not removed or effectively protected prior to commencement of the Works;
  2. pre-existing defects or conditions at the Property; or
  3. work conducted by third parties.

13. Insurance

Bodes Brushes will maintain public liability insurance of not less than $5,000,000 per occurrence for the duration of the Works. A certificate of currency will be provided to the Customer upon request.

14. Risk

Bodes Brushes bears the risk of loss or damage to its own tools, equipment, and materials.

The Customer bears the risk of loss or damage to the Property and its contents, except to the extent that such loss or damage is caused by the negligence or wilful default of Bodes Brushes.

15. Termination

Either party may terminate the agreement immediately if the other party materially breaches the agreement and does not remedy that breach within 7 days of receiving written notice requiring remedy.

If the Customer terminates, the Customer will pay Bodes Brushes for all Works completed to the date of termination, together with any costs properly incurred by Bodes Brushes up to that date.

If Bodes Brushes terminates, Bodes Brushes will refund to the Customer any amount already paid in respect of Works not yet performed.

16. Dispute Resolution

If a dispute arises in connection with these Terms and Conditions or the Works, the parties will first attempt to resolve the dispute by negotiation in good faith. If the dispute is not resolved within 14 days of one party notifying the other of the dispute, either party may refer the matter to the NSW Civil and Administrative Tribunal or a court of competent jurisdiction.

17. Notices

Any notice or communication required or permitted under these Terms and Conditions must be in writing and may be delivered by hand, email, or post to the address of the relevant party as set out in the Quote or as otherwise notified in writing.

18. General

  1. These Terms and Conditions, together with the accepted Quote, constitute the entire agreement between the parties and supersede all prior discussions, negotiations, and agreements relating to the subject matter.
  2. Any variation to these Terms and Conditions or the scope of the Works must be in writing and agreed by both parties.
  3. If any provision of these Terms and Conditions is or becomes illegal, invalid, or unenforceable, it is to be read down to the extent necessary or severed from these Terms and Conditions, and the remaining provisions continue in full force and effect.
  4. A failure or delay by either party in exercising any right under these Terms and Conditions does not operate as a waiver of that right.
  5. These Terms and Conditions are governed by the laws of New South Wales and each party submits to the exclusive jurisdiction of the courts of New South Wales.
